PHILADELPHIA - A federal appeals court has thrown out a $550,000 fine against CBS Corp. for the 2004 Super Bowl halftime show that ended with Janet Jackson's breast-baring "wardrobe malfunction."

The three-judge panel in Philadelphia ruled Monday that the Federal Communications Commission "acted arbitrarily and capriciously" in issuing the fine for the fleeting image of nudity.

The 90 million people watching the Super Bowl, many of them children, heard Justin Timberlake sing, "Gonna have you naked by the end of this song," as he reached for Jackson's bustier.

America amazes me every time. I'm glad they dropped the case. Seriously we are at war and their worried about 2 seconds of a boob? . What's worse is that Justin didnt even get any of the blame, which shows an even worse side :dsp:

What's sad is that it takes 4 and 1/2 years to decide what to do about a micro-second flash of a partial-breast? Unbelievable.

No wonder we are in so much trouble as a nation .. we waste time, money and effort on trivial issues. Shouldn't our focus be economical improvement, male/female pay equity, gun violence & continuing school shootings, our dependence on foreign oil, the war in Iraq, the scary on-going developments in Iran, etc. etc. etc.

Instead, we focus on Janet Jackson's boob-glimpse over 4 years ago. God help us all!

I'll never understand why people make such a big deal over public displays of breasts... I can walk around all day with no shirt on and it's no big deal, but if a woman's tit gets flashed on a tv screen for less than a second, it's the end of the world!

If I were in charge of the world (and one day I will be), I would have the most prominant leaders of people who are anti-tit come to my office, line up outside and each would get a chance to explain to me why women's breasts are obscene.

If they failed to make a compelling and intelligent argument, I'd push a button, the trap-door would open, and it would be into the pit of alligators for the fucker.

I really don't know which disgusts me more, the inanity of the issue itself or the amount of taxpayer dollars that were spent dealing with it.

I think if a court finds that the FCC wrongfully fines a person, the FCC should have to pay damages equal to twice the amount that they originally fined the person.
